The short answer: If you are 55 or older, California's Proposition 19 lets you sell your long-time South OC home and keep much of your low property tax base on a replacement home anywhere in California. You can use it up to three times, as long as you buy within two years of selling. That one rule often saves downsizers thousands of dollars a year, and it makes single-level homes and 55+ communities in Rancho Mission Viejo and Mission Viejo far more affordable to move into.

Many of my clients have owned their South OC homes for 20 years or more. Here is how I help them downsize without giving up their tax advantage or their neighborhood.

How Prop 19 works

An example (illustrative only): Say you bought your Mission Viejo home in 2000 and its taxable value has grown to about $450,000. You sell for $1.3 million and buy a single-level home for $1.1 million. Your new taxable value stays near $450,000, so your base tax stays around $4,500 a year instead of about $11,000. If you bought a $1.5 million home instead, your taxable value would be about $450,000 plus the $200,000 difference, or $650,000.

Local assessments, bonds, and any Mello-Roos are added on top of the base tax. Confirm your numbers with the Assessor or a tax professional before you commit.

Where to downsize in South OC

  • Rancho Mission Viejo (Gavilán 55+ neighborhoods): Single-level homes with private 55+ clubhouses plus access to all-ages amenities, so grandkids can visit the pools. Gavilán Ridge homes were priced from the mid-$900,000s to nearly $2 million.

  • Mission Viejo: Two age-qualified communities plus many single-story homes in established neighborhoods, some with Lake Mission Viejo access.

  • Laguna Niguel and Ladera Ranch: Single-level condos and townhomes let you stay close to friends, family, and your current routines.

Sell first or buy first?

A common solution is to sell with a rent-back of 30 to 60 days, which gives you time to close on the next home. Prop 19's two-year window means your tax benefit is safe either way, as long as both transactions fall inside it.

My take: Prop 19 is a fantastic tool for homeowners 55 and older. It lets you move to a home that better suits this stage of life without the large property tax increase a younger buyer would face on the same purchase. Always consult a tax advisor about your personal situation.

Frequently asked questions

Can I use Prop 19 if I move out of Orange County? Yes. Under Prop 19, the replacement home can be anywhere in California.

Does my spouse need to be 55 too? Only one owner who lives in the home needs to be 55 or older.

Can I buy a more expensive home and still benefit? Yes. The difference in price is added to your transferred base value, so you still keep part of the benefit.

How long do I have to file? File the claim with the Assessor promptly after buying the replacement home. Ask your escrow officer to remind you.
